Festus-area man charged for alleged assault

Edward Allen Luck, 38, of the Festus area has been accused of threatening to shoot a woman before hitting her as she drove him home from the Jefferson County Courthouse, according to court documents.

The Jefferson County Prosecuting Attorney’s Office on June 13 charged Luck with third-degree assault, a class E felony, and second-degree harassment, a class A misdemeanor. He was arrested on June 22, and as of June 27, he was being held on $10,000 cash-only bond at the Jefferson County Jail in Hillsboro, court records said.

The Prosecuting Attorney’s Office has asked the court to consider the assault charge a class D felony, which is punishable by up to seven years in prison, because he is a persistent offender. Luck pleaded guilty to possession of a controlled substance on Jan. 8, and he pleaded guilty to felony domestic assault in August 2010, according to court documents.

A class misdemeanor is punishable by up to one year in jail and a fine of up to $2,000.

According to the case’s probable-cause statement, the woman said she was driving Luck home on May 23 after he appeared in court. She said the two started to argue while she was driving, and Luck pulled out a gun and allegedly threatened to “pistol whip” and shoot her.

The woman also told investigators Luck wiped down the gun and put it under the driver’s seat, and he allegedly said if she was stopped by the police, he would tell officers the gun belonged to her. He then allegedly repeatedly shifted the vehicle into neutral while she was driving, the report said.

Luck allegedly hit the woman in the face while she was driving, and after they got to the woman’s home southwest of Festus, he grabbed the gun and started to walk north along Hwy. CC, according to the report.

Jefferson County Sheriff’s Office deputies reported Luck was not in the area when they arrived at the woman’s home.
