The Jefferson County Prosecuting Attorney’s Office has filed charges against a St. Louis man for allegedly firing a gun outside a home in the Festus area. Marco Capone Arrington, 18, allegedly shot a gun at a party in the 12000 block of Hwy. TT south of Festus, the Jefferson County Sheriff’s Office reported.
The Prosecuting Attorney’s Office on Dec. 31 charged Arrington with unlawful use of a weapon, a class B felony punishable by five to 15 years in prison, and armed criminal action, an unclassified felony that carries a penalty of three to 15 years in prison, court records show.
As of today, Jan. 2, Arrington was being held without bond at the Jefferson County Jail in Hillsboro, according to court documents.
Sheriff’s Office deputies were called at about 10 p.m. Dec. 26 to the Festus-area home due to the alleged shooting. A birthday party was being held at the home when Arrington and others arrived in an unidentified vehicle, according to the case’s probable-cause statement.
People at the home began to argue with those who arrived in the vehicle. Arrington then got out of the vehicle and allegedly fired a gun into the air, and after he and others got back into the vehicle, he allegedly shot at people outside the home while the vehicle drove away, the report said.
No one was struck by the gunfire, and no injuries were reported. Investigators found .45-caliber shells outside the home, and one vehicle was hit by a bullet, according to the report.
Investigators tracked the vehicle to a home in Jefferson County, and two people who answered the door said they were in the vehicle at the party and that Arrington fired the gun. A third person at the home also said Arrington fired the gun, the report said.
Arrington was at the home and was arrested. Investigators also found a .45-caliber Kimber gun inside a Gucci bag at the house, according to the report.
Arrington allegedly told the investigator he shot the gun one time into the air while outside the vehicle and fired the gun two or three times while the vehicle drove away from the home. He also described the gun and bag that investigators found in the home, the report said.
The gun had been reported stolen to St. Louis Police, Arrington allegedly told investigators he purchased the gun from a friend, the probable-cause statement said.
