Festus-man faces domestic assault charges

Kyle Dwayne Gardner, 56, of Festus has been accused of hitting a woman multiple times with various items in an apartment in the 800 block of North Fifth Street in Festus, according to court documents.

The Jefferson County Prosecuting Attorney’s Office on May 16 charged Gardner with two counts of first-degree domestic assault, class B felonies, two counts of armed criminal action, unclassified felonies, and one count of third-degree domestic assault, a class E felony, court records show.

Gardner was arrested the day after the alleged assault. As of May 28, he was being held without bond at the Jefferson County Jail in Hillsboro. He is scheduled to appear in court on June 27 for a preliminary hearing, court documents show.

According to the case’s probable-cause statement, Gardner allegedly began striking a woman with his fist at about 8:30 p.m. May 15 in the apartment they shared. He also allegedly hit the woman with a wine bottle, picture frame, wooden bowl, glass candle jar and a mason jar.

Gardner allegedly attempted to force the woman to have sex with him, and he told her that he planned to kill her and then himself. He also allegedly slammed the woman’s head on a kitchen table multiple times and tried to stab her with a butter knife, the report said.

The woman was able to get a gun, and Gardner left the apartment after she had the weapon, according to the report.

The woman had multiple cuts on her head, and her left eye was bruised and swollen. She also had a cut on her right forearm and left middle finger, Festus Police reported.

A class B felony is punishable by five to 15 years in prison, and an unclassified felony carries a penalty of three to 15 years in prison. A class E felony is punishable by up to four years in prison.
