James Lee Brake, 59, of Barnhart has been accused of firing a gun at least two times outside of a home in the 4600 block of Schenk Road in Barnhart. No one was injured and there were no reports of damage, according to court documents.
Brake on April 9 was charged with felony unlawful use of a weapon. He was arrested on April 16, and as of Monday, he was being held on a $10,000 bond at the Jefferson County Jail in Hillsboro, court and jail records said.
Last year, he was charged with alleged possession of illegal drugs and paraphernalia following his arrest in October 2024 for breaking a restraining order by being within 250 feet of the same home.
A Jefferson County Sheriff’s Office deputy arrested Brake for breaking the terms of the restraining order. The deputy allegedly found Brake with a blue pill and a glass smoking pipe and a straw with residue on them. He told the deputy the pill was Xanax and that he did not have a prescription for the drug, according to that case’s probable-cause statement.
The most recent charge against Brake stems from an alleged incident in September 2025. Brake arrived at the home in a blue Honda Civic, and he allegedly pointed a gun at a man outside the home, according to the case’s probable-cause statement.
The man went inside the house and then heard at least two gunshots. The man said when he went back outside Brake and the Civic were gone, the report said.
A woman at the home had been in contact with Brake prior to the alleged shooting. She also said she heard two gunshots, according to the report.
A deputy found a shell casing near were the man was standing before going inside, the report said.
An investigator spoke to Brake on April 10. Brake allegedly said he wasn’t sure if he was at the house the day of the shooting, but he also said he went to the home often. Brake also said he does not own a Civic, according to the report.
