Barnhart man charged with drug possession

James Lee Brake, 58, of Barnhart has been charged for alleged possession of illegal drugs and paraphernalia following his arrest for reportedly breaking a restraining order. He allegedly was within 250 feet of a Barnhart home he was not allowed to approach, according to court documents.

Brake was arrested on July 21, and as of July 23, he was being held on a $4,000 bond at the Jefferson County Jail in Hillsboro, court records said.

The Jefferson County Prosecuting Attorney’s Office on April 30 charged Brake with possession of a controlled substance, a class D felony punishable by up to seven years in prison; and unlawful possession of drug paraphernalia, a class D misdemeanor that carries a penalty of a fine up to $500, according to court documents.

Brake was arrested in October 2024 when he was seen near a home in the 4600 block of Schenk Road in Barnhart, Jefferson County Sheriff’s Office Capt. Matt Moore said, and Brake received an ex-parte order on Oct. 17, 2024, not to go within 250 feet of the home, according to the probable-cause statement in the case.

During his recent arrest, Brake allegedly was about 162 feet from the home when a deputy found him. Brake told the deputy he was there to pay a water bill for the home, the report said.

The deputy arrested Brake for allegedly breaking the terms of the restraining order. The deputy than allegedly found Brake with a blue pill and a glass smoking pipe and a straw with residue on them. He allegedly told the deputy the pill was Xanax and that he did not have a prescription for the drug, according to the report.
