Josh R. Smith, 26, of Festus has been sentenced to seven years in prison following felony drug possession and assault charges and a probation violation, according to court documents.
In July 2010, Smith was driving in the parking lot at Shop ‘n' Save on Truman Boulevard in Festus and lost control of his pickup, which struck a pillar and row of shopping carts, which then struck a Festus woman and Pevely man, hurting both of them, the probable-cause statement said.
Inside Smith's pickup, police officers found a syringe and spoon with white residue on it and three empty capsules and three capsules filled with a white powder, which tested positive for heroin. Smith admitted that he had injected heroin about an hour before the accident, and his blood contained THC, the report said.
Smith pleaded guilty to possession of a controlled substance and two counts of second-degree assault and in March 2013, he was sentenced to three seven-year terms, one for each of the charges. However, the terms, which were to be served concurrently, or at the same time, were suspended and he got five year’s probation, court papers show.
He violated the probation, though, and on July 8, Jefferson County Div. 1 Circuit Judge Robert G. Wilkins executed the seven-year terms, to be served concurrently, the report said.
Jefferson County assistant prosecuting attorney Catherine M. Robertson handled the case.
Those terms also are to be served concurrent with two six-year terms Smith previously was sentenced to on felony burglary charges stemming from July 2010 and August 2010 incidents in Jefferson County and with two six-year terms on felony forgery charges connected to an August 2010 incident in Jefferson County.
He currently is in the Eastern Reception, Diagnostic and Correctional Center in Bonne Terre.
