Shawn M. Davis, 40, of De Soto, a chronic offender, has been sentenced to 10 years in prison after his fifth DWI, court records show.

In September 2015, a Byrnes Mill Police officer pulled over Davis at Hwy. 30 and Hunter Lane for not having a working license plate light. Davis showed signs of impairment and was found to be intoxicated after failing three field sobriety tests, the probable-cause statement said.

Davis already was wanted in De Soto on an outstanding warrant and was transported to the Jefferson County Jail where he was found with a baggie of marijuana. In addition, he consented to a breathalyzer test and had a blood-alcohol concentration of .216 percent, the report said. The legal limit in Missouri is .08.

Davis pleaded guilty to DWI - chronic offender, and on Dec. 6, 2016, Jefferson County Div. 3 Circuit Court Judge Nathan B. Stewart sentenced him to 10 years in prison, the report said.

Davis already was on probation for two previous DWI convictions, so also on Dec. 6, 2016, Stewart executed two other prison terms Davis previously had been sentenced to, according to the report.

In November 2013, Davis was pulled over for speeding on westbound Hwy. 30, approaching Betty Hill Drive in Byrnes Mill, and the officer said Davis smelled of alcohol and failed three field-sobriety tests. In addition, his blood-alcohol concentration was .188, according to a probable-cause statement.

Davis pleaded guilty as a DWI aggravated offender, and on July 22, 2015, he was sentenced to five years, but the sentence was suspended, and he got five years’ probation, court papers indicate.

In August 2011, Davis was arrested for a DWI after a traffic accident at Bear Creek Road east of Carol Park Road in House Springs. A Missouri State Highway Patrol trooper said Davis smelled of alcohol and failed two field sobriety tests before being taken to Barnes-Jewish Hospital in St. Louis for treatment, a probable-cause statement said.

Davis pleaded guilty to being a persistent offender on Jan. 28, 2013, and received a three-year sentence, but in December 2014, after completing community service and a treatment program, he was released and got five years’ probation.

The 10-year, five-year and three-year terms are to be served concurrently, or at the same time, the report said.

Jefferson County assistant prosecuting attorney Thomas E. Hollingsworth handled the cases.

Davis previously was convicted of two other DWIs – one stemming from an April 2010 incident and the other from a February 2007 incident, both in Jefferson County.

Davis is currently in the Eastern Reception, Diagnostic and Correctional Center in Bonne Terre.
