Eureka-area man allegedly attacks woman, burns her belongings

Terry Frederick Upshaw, 28, who lives southeast of Eureka, has been accused of ramming a car that a woman who he lives with was driving on Jim Weber Road and burning some of the woman’s belongings that were in a shed at a home they lived together in, according to court documents.

Upshaw has been charged with felony counts for third-degree domestic assault, armed criminal action, first-degree property damage and knowingly burning or exploding. He was arrested on May 30, and as of June 4, he was being held on a $75,000 bond, court records show.

According to a probable-cause statement filed by the Jefferson County Sheriff’s Office, Upshaw and the woman were arguing on May 30 at a home in the 7800 block of Jim Weber Road southeast of Eureka. Upshaw left the home and drove away during the argument after he told the woman to leave.

When the woman drove away from the home, Upshaw allegedly rammed the back of the car she was driving on Jim Weber Road. The woman stopped after being hit, and Upshaw went to the car she was in, yelled at her and kicked the back passenger’s side door, the report said.

The woman drove away from Upshaw. However, he got back in the car he was driving, and he allegedly hit the car she was driving four or five more times before she was able to get away from him, according to the report.

The deputy wrote the estimated cost to repair the damage to the car that woman was driving was $850.

Deputies were called to the home on Jim Weber Road later that day, when Upshaw allegedly was seen setting a shed on fire. The shed was near his and the woman’s home, and it had tools that belonged to the woman inside it, the report said.

The woman told investigators about $2,000 worth of tools were destroyed in the fire, according to the report.

A man said he saw Upshaw near the shed when it was on fire. He said Upshaw walk around the burning shed before driving away, the report said.

Upshaw allegedly told the woman earlier in the day that if she did not leave, he would destroy her belongings, according to the report.
