Richard S. Bates, 27 of Fenton has been sentenced to 10 years in prison for burglary, stealing and other felony charges, according to court records.
In May 2012, Bates unlawfully entered a neighbor’s home on Creek Drive in the Fenton area while the victim was inside asleep and stole a handgun, a blank gun, a cell phone and car keys, the probable-cause statement said.
The victim woke up during the burglary and shot two rounds at Bates, striking him once in the back of his left leg, the report said.
After he was shot, Bates ran from the home and dropped the guns in a creek in the area, according to the report.
Bates, who already had a felony conviction, pleaded guilty to first-degree burglary, stealing of a firearm and unlawful possession of a firearm in connection with the May 2012 incident, the report said.
He was sentenced in January 2013 to 10 years for the burglary charge and to two seven-year terms, one for each of the other charges, with all the terms to be served concurrently, or at the same time. However, after completing a treatment program, he was released in April 2014, the sentences were suspended and he got five years’ probation, court papers show.
Bates violated his probation, though, and on July 15, 2015, Jefferson County Div. 3 Circuit Judge Nathan B. Stewart executed the 10-year and two seven-year terms, all to be served concurrently, court documents indicate.
Jefferson County assistant prosecuting attorney Douglas S. Pribble handled the case.
Bates already had been sentenced to four other seven-year terms for burglary, theft and receiving stolen property charges, and all those terms also are to be served concurrent with the most recent ones, according to court records.
He currently is in the Tipton Correctional Center.
